Refresher Course Content Use Policy

Refresher Course & Content Ownership:

All content and materials provided in or through The American College of Financial Services’ (‘The College’) Refresher courses (‘Refresher Course Content’) are the exclusive property of The College, its licensors or other applicable third-party rights holders and are provided in accordance with and protected by applicable intellectual property and copyright laws.

Refresher Course Content Permitted Uses:

Refresher Course participants are granted a limited, personal, non-exclusive, non-transferable, and revocable right to access and use Refresher Course Content solely for their own individual educational purposes. Participants may apply the general knowledge, principles, skills, and concepts learned through a Refresher Course in their own professional practice. No ownership or other intellectual property rights in Refresher Course Content are transferred to Refresher Course participants.

Refresher Course Content Use Restrictions:

Unless expressly authorized in writing by The College, Refresher Course participants may not:

print, download, copy, photograph, screenshot, record, reproduce, publish, upload, distribute, sell, license, share, or otherwise make Refresher Course Content available to another person or organization;
modify, adapt, repurpose, or create materials derived from or substantially based upon Refresher Course Content;
use Refresher Course Content to create, develop, deliver, market, or sell any course, training program, study aid, reference material, publication, presentation, knowledge base, product, or service;
share Refresher Course access credentials or permit any unauthorized person to access Refresher Course Content; or
remove, modify, edit or circumvent any copyright notice, watermark, access control, or other proprietary or security feature.

Refresher Course Content and Artificial Intelligence (‘AI’) and Automated Tools’ Use Restrictions:

Except as provided below, Refresher Course participants may not upload, enter, copy, paste, transmit, submit, or otherwise provide Refresher Course Content to any artificial intelligence (AI), generative AI, large language model, machine-learning system, chatbot, automated tool, or similar technology or service.

This restriction includes using Refresher Course Content for summarization, analysis, content generation, training or fine-tuning, retrieval-augmented generation (RAG), creation of a knowledge base, or other storage or processing by an automated system.

*This restriction does not apply to AI tools or other technology expressly provided or authorized by The College for use within the Refresher Course, including SPARK, provided it is used in accordance with The College's applicable requirements.

Exceptions and Enforcement:

Any exception to this policy must be approved in writing in advance by the Provost or the Provost's authorized designee, which may include but not be limited to the Vice Provost or Assistant Provost responsible for Teaching & Learning.

Violations of the policy may result in suspension or termination of Refresher Course access and other action or remedies available to The College under applicable policy, contract, or law.

These obligations with respect to Refresher Course Content continue after a participant's course access ends. All rights not expressly granted are reserved.
